Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Fatehpur P.S. Case No. 185 of 2021 dated 07.06.2021 lodged under Sections 364(A) and 365/34 of the I.P.C. As per the prosecution case, the name of the petitioner has figured in kidnapping of the victim.

Learned counsel for the petitioner submits that the F.I.R. has been lodged against Chandan Kumar and not against the petitioner. He also submits that the name of the petitioner has figured in this case by virtue of the confessional statement of Karu Singh and other co-accused, namely, Chandan Kumar

Patna High Court CR. MISC. No.9495 of 2023(2) dt.03-05-2023 2/2 and Raushan Kumar Paswan have been granted bail by the Coordinate Bench of this Court vide orders dated 05.05.2022 and 14.12.2022 passed in Cr. Misc. Nos. 59627 of 2021 and 70341 of 2022 respectively.

Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-Xth, Gaya in connection with Fatehpur P.S. Case No. 185 of 2021, subject to the conditions as laid down under Section 437(3) of Cr.P.C.. With this observation, the bail application stands allowed.
