1. Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 354(B), 379, 504 and 506/34 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that petitioner no. 1 has antecedent of two cases and petitioner no. 2 has antecedent of one case and petitioner no. 1 is own brotherin-law (Bhainsur) of the informant and petitioner no. 2 is son of petitioner no. 1. It is further submitted that on account of dispute relating to property, the present FIR has been instituted by the informant at the instance of her husband. It is next submitted that informant alleges that the petitioners intended to outrage the

Patna High Court CR. MISC. No.12555 of 2024(4) dt.26-07-2024 2/2 modesty of the informant and even assaulted her but then submits that the injury is simple in nature which amply demonstrates that petitioners never had any intention of committing a serious offence.

4. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

5. Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Laukaha (Lalmaniya) P.S. Case No. 215 of 2021, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

6. In compliance of the order dated 25.07.2024, the Investigating Officer of the case is present. The personal appearance of the Investigating Officer is dispensed with. (Satyavrat Verma, J) Kundan/- U T
