The petitioner has preferred this application for grant of regular bail in a case registered under sections 30(a) and 38 of the Bihar Prohibition and Excise Act, 2016. As per allegations in the FIR, 452 litres of IMFL was recovered from the under-construction house of one Naresh Singh. It is further stated that it transpired that the petitioner and others were involved in the business of liquor. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from his possession. He has been falsely implicated in the case. He is in custody since 9.1.2021 and has no criminal antecedent. Coaccused Naresh Singh has been enlarged on bail vide order

Patna High Court CR. MISC. No.18980 of 2021(2) dt.01-09-2021 2/2 dated 14.1.2020 passed in Cr. Misc. no. 85728 of 2019. Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case including the petitioner not having any criminal antecedent, the Court directs the petitioner to be enlarged on bail in connection with Excise Case no. 1375 of 2019 (arising out of Charpokhari P.S. Case no. 147 of 2019) on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise Act, Bhojpur at Ara.
