JUSTICE AMARESH KUMAR LAL ORAL ORDER 22-01-2015 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.
The petitioner is in custody since 25. 08. 2014 in a case registered for the offence punishable under Sections 147, 148, 149, 341, 323, 324, 307, 504, 506 and 379 of the Indian Penal Code.
Allegation against the petitioner is to have assaulted Ajay Yadav by Farsa on his head.
It is submitted that there is land dispute between both the parties. It is further submitted that prior to filing of the present case, Amarjit Yadav, nephew of the petitioner has been filed a case against the informant and other bearing Saharsa P.S. Case No. 528 of 2013. However, no injury report referred in the case diary. The petitioner has no criminal antecedent.
Patna High Court Cr.Misc. No.43080 of 2014 (3) dt.22-01-2015 Considering the facts and circumstances of this case, the above-named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of Sri D. Kumar, Judicial Magistrate 1st Class, Saharsa, in connection with Saharsa Sadar P.S. Case No. 529 of 2013 with the following conditions : 1.
One of the bailors will be the close relative of the petitioner.
2.
The petitioner will not indulge in similar or in any other offence.
3.
The petitioner will be well represented in the court.
4. In case of absence for two consecutive dated or in violation of the terms of the bail, his bail bond will be liable to be cancelled by the court concerned.
