This is an application for grant of regular bail on behalf of the petitioner who is an accused in connection with Karpi (Sahar Telpa O.P.) PS Case No. 62 of 2014 (GR No. 832 of 2014) for the alleged offences punishable under Sections 302/34 of the Indian Penal Code.
It is submitted on behalf of the petitioner that prosecution case as narrated in the First Information Report is falsified by the post-mortem report which does not show any external injury on the body of the deceased. Referring to the FIR, he has submitted that property dispute between the parties is an admitted fact. Charge-sheet in the case is said to have already filed. It is accordingly contended that no useful purpose would be
Patna High Court Cr.Misc. No.47395 of 2015 (2) dt.16-10-2015 2/2 served by keeping the petitioner in jail.
In view of the submission aforesaid, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Arwal, in connection with Karpi (Sahar Telpa O.P.) PS Case No. 62 of 2014.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
