The petitioner seeks bail in connection with Nardiganj P.S. Case No.134 of 2014 registered under Sections 498(A) and 304(B)/34 of the Indian Penal Code.
The prosecution case is that the marriage of Lalo Devi, the younger sister of the informant Sadan Choudhary, was performed with the petitioner about eight years back and she had also a son aged about three years but she was being tortured by her husband (petitioner) and other in-laws. On 23.08.2014, sister-inlaw of Lalo Devi, informed the informant about killing of Lalo Devi by her husband (petitioner) and other in-laws.
Patna High Court Cr.Misc. No.46699 of 2015 (3) dt.15-02-2016 2/2 Learned counsel appearing on behalf of the petitioner submits that the petitioner is the husband of the deceased Lalo Devi. In fact, the deceased was of short temperament mind, due to that reason, she committed suicide by handing herself and information regarding the said occurrence was given to the informant but due to ulterior motive, the informant has lodged this false case. Further submission is that the Investigating Officer after investigation of the case submitted chargesheet under Section 306/34 of the Indian Penal Code. The petitioner having no criminal antecedent is in custody since 04.03.2015. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada, in connection with Nardiganj P.S. Case No.134 of 2014/G.R. No.2380 of 2014.
