Heard learned counsel for the petitioner, learned A.P.P. for the State along with learned counsel for the OP No. 2. 2.

The petitioner apprehends her arrest in a case registered for the offences punishable under Sections 147, 149, 307, 302, 504 and 506 of the Indian Penal Code. 3.

Learned counsel for the petitioner submits that petitioner has antecedent of one case under the Bihar Excise Act. It is next submitted that she, being mother of Dharmendra Sahani, has been falsely implicated in the present case by the informant. It is next submitted that allegation is of assault against the accused persons on account of which the injured during the course of treatment died but then as far as the petitioner is concerned, there is no specific allegation against her and she is a woman. It is also submitted that entire family

Patna High Court CR. MISC. No.11043 of 2024(2) dt.07-03-2024 2/2 members have been implicated.

The learned APP along with the learned counsel for the OP No. 2 opposes the prayer for anticipatory bail of the petitioner but are not in a position to rebut the submission of the learned counsel for the petitioner that there is no specific allegation of assault against this petitioner and she is mother of Dharmendra Sahani, who is also an accused in the present case. 5.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of her arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Nautan P.S. Case No. 442 of 2023 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
