The petitioner is accused in connection with Tekari P.S. Case No.81/2014 registered under Sections 304B, 120(B) and 328 of the Indian Penal Code.
The accusation is of killing of Indu Kumari, daughter of informant due to non-fulfillment of demand of cash and motorcycle as dowry by administering poison.
Learned counsel for the petitioner submits that petitioner is husband of deceased, who was complaining about biting of some animal in the leg. She was rushed to village doctor and from where she was being taken for treatment but she died in the way.
Patna High Court Cr.Misc. No.46782 of 2015 (4) dt.23-02-2016 Admittedly, the deceased died within two years of her marriage at her sasural. In postmortem report, the cause of death expressed due to poisoning while the viscera was kept reserved.
Taking into consideration the facts and circumstances of the case and the nature of allegation, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner is rejected.
