The petitioner is in custody in connection with Amarpur P.S. Case No. 214 of 2018 for the offence under Section 411, of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. He further submits that petitioner was apprehended in connection with theft of motorcycle. Learned counsel for the petitioner submits that petitioner is a motorcycle mechanic and recovery of motorcycle part is not uncommon from motorcycle mechanic. Learned counsel for the petitioner submits that petitioner is in custody since 06.09.2018.

No.7909 of 2019(2) dt.11-02-2019 2/2 Considering the fact that petitioner has no criminal antecedent and he has remained in custody nearly five months, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Court of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 214 of 2018.
