1. Heard the parties.
2. The petitioners apprehend their arrest in connection with RC 02320 14A0008 Dt. 23.05.2014 registered under Section 120-B, 420, 468, 471 of the I.P.C. and Section 13(2) read with Section 13(1)(d) of the Prevention of Corruption Act.
3. As per the prosecution case the petitioners obtained appointment on the post of Gramin Dak Sewak on the basis of forged Madhyama certificate.
4. Learned counsel for the petitioners submits that petitioners were appointed after full verification of their documents and testimonials but later on the same have been declared as forged and fabricated. Similarly situated co-accused persons Manoj Kumar and Mangal Pandey have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 15145 of 2025 & Cr. Misc. No. 7722 of 2025
3/4 respectively. After investigation, charge sheet has been submitted and there is no likelihood that the petitioners will abscond or tamper with the evidence.

Learned counsel for the C.B.I. on the other hand opposed the prayer for anticipatory bail and submits that the offence is serious in nature and in such kind of offence anticipatory bail may not be granted that too after submission of charge sheet having prima facie material against the petitioners.

Regard being had to the submission made by the parties, taking into consideration the fact that investigation in the matter is complete, charge sheet has been submitted, there is no likelihood that the petitioners shall abscond or tamper with the evidence and similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, accordingly, I am inclined to grant anticipatory bail to the petitioners.
7. Let the petitioners, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, CBI, Muzaffarpur in connection with
4/4 RC 02320 14A0008 Dt. 23.05.2014 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023 as well as the following conditions:- (i) that the petitioners shall remain present on each and every date before the C.B.I. court and in case on default on two consecutive dates without prior permission of the C.B.I. court their bail bond shall liable to be cancelled.
(ii) that the petitioners shall not leave the territory of the country without obtaining prior permission from the C.B.I. Court.
