JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-09-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State as also heard learned counsel, appearing for the complainant. Petitioner being husband of the complaint, is languishing in jail custody since 22-01-2015 in a case, in which, cognizance has been taken for the offence punishable under Section-498A of the Indian Penal Code and Sections-3/4 of Dowry Prohibition Act.
Earlier petitioner was granted provisional bail by this court but when the dispute of the parties could not be resolved, again petitioner was taken into custody.
Learned counsel for the complainant submits that the
Patna High Court Cr.Misc. No.12506 of 2015 (4) dt.28-09-2015 2/2 complainant is still ready to lead her conjugal life with the petitioner but the petitioner does not want to keep the complainant with full honour and dignity.
Considering the above-said submission as well as facts and circumstances of the case, the provisional bail granted to the petitioner vide order dated 03-08-2015 is, hereby, confirmed. This petition is, accordingly, disposed off.
