2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 352 and 3(5) of the BNS, 2023 and under Section 27 of the Arms Act.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that he objected to children playing on the husk, hence it is alleged that Gautam and Manish fired, but missed.
4. Learned counsel appearing on behalf of petitioner submits that petitioner has been falsely implicated in the instant case by the informant with an allegation that he fired but missed. It is next submitted that on account of dispute
Patna High Court CR. MISC. No.8082 of 2025(2) dt.06-03-2025 2/2 relating to playing of children, an altercation has taken place in which both sides had abused each other, but in order to give seriousness to the case, false allegation of firing was alleged. It is lastly submitted that petitioner is not a criminal.
5. Learned Additional Public Prosecutor for the State opposes the prayer for anticipatory bail of the petitioner.
6. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial Court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of the learned trial Court, where the case is pending / successor Court, in connection with Daniyawan P.S. Case No. 207 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Satyavrat Verma, J) Shahnawaz/- U T
