====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 06-05-2019 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends her arrest in connection with Harnaut (Telmar) P.S. Case No.202 of 2018 registered under Sections 306 and 201/34 of the Indian Penal Code.

The accusation is that the informant, who is the Officer Incharge of Telmar Police Station, received information from the Chowkidar Dipak Paswan to the effect that Shradha Devi due to quarrel with her son Ramesh and daughter-in-law (petitioner) put herself on fire. On receiving such information, the informant along with other police officials, giving direction to local Chowkidar to remain present at Tapkaliya Bridge, went there, where Chowkidar Dipak Paswan was present since before, and on search, found the dead body of an women covered with blanket concealed near the

Patna High Court CR. MISC. No.8008 of 2019(5) dt.06-05-2019 2/2 bridge, which was identified by the Chowkidar Dipak Paswan and the villagers as that of Shradha Devi.

Learned counsel appearing on behalf of the petitioner submits that, in fact, due to quarrel in between the husband of the petitioner and her mother-in-law (Shradha Devi), Shradha Devi made attempt to put herself on fire but was saved and rushed for treatment at the hospital but she died in course of treatment. With an ulterior motive, the petitioner being the wife of the co-accused Ramesh Chaudhary, son of the deceased Shradha Devi, has falsely been implicated in this Case. The petitioner, who is lady, has no criminal antecedent.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Harnaut (Telmar) P.S. Case No.202 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
