Petitioner is not named in the first information report and his name surfaced in the confessional statement of co-accused and apart from this, one motorcycle bearing registration no. BR 39 H-9456 is said to have been recovered from possession of the petitioner. Learned counsel for the petitioner submits that motorcycle bearing registration no. BR 11H-9456 is said to have been used in commission of the present crime and, as a matter of fact, seized motorcycle has not been used in the present crime. Accordingly, petitioner is directed to be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Purnea in Barhara ( Raghuwans Nagar) P.S.
