Mr.Arun Kumar Singh ====================================================== CORAM: HONOURABLE MR. JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-02-2019 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is languishing in custody since 21.07.2018 in connection with Lakhisarai (Kabaiya) P.S. Case No.17 of 2018 registered for the offences punishable under Sections 467, 468, 406, 409, 470, 471 of the Indian Penal Code but chargesheet submitted under Section 419, 420, 467, 406, 408, 470, 471, 120(B) of the I.P.C.

Prosecution case as per the written report of Executive Engineer, Lower Kuel Project Division submitted to SHO Kabaiya P.S. is to the effect that the petitioner Dhananjay was posted as Clerk-cum-Typist in the aforesaid project and withdrew Rs.22,28,814/- from State Bank of India, Lakhisarai

Patna High Court Cr.Misc. No.7979 of 2019(2) dt.13-02-2019 2/2 and Bank of India, Bhagalpur and misappropriated the same. It is submitted by learned counsel for the petitioner that the petitioner is a Government servant and salary and provident fund amount is under the jurisdiction of the Bank from where, the said amount is alleged to have withdrawn. It is further submitted that investigation has already been concluded and the petitioner is accused in one other case apart from the present case in which he is on bail.

Learned APP submits that the petitioner has misappropriated the money and is named in the FIR. Considering the fact that investigation has already been concluded and the period of custody, let the above named petitioner be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Lakhisarai (Kabaiya) P.S. Case No.17 of 2018.
