JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 The petitioner seeks regular bail in connection with Tarabari P.S. Case No. 24 of 2019, registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 36 litres of Nepali liquor from a motorcycle and the rider of the motorcycle managed to flee away, later on, during course of investigation, name of petitioner transpired with allegation that he was riding the motorcycle.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and in fact nothing has been recovered from the petitioner and the motorcycle from the recovery was made, does not belong to the petitioner. Further he has no criminal antecedent and has been in judicial custody

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned 02nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Tarabari P.S.
