The petitioner seeks bail in a case instituted for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 109, 114, 117, 427, 435, 379, 504, 506, 511 of the Indian Penal Code and Section 3 of Damage of Public Property Act.

The prosecution case in short is that on information, when the informant along with police party reached the place of occurrence for taking the accused persons in custody, the anti social elements attacked on police party due to which they sustained injury.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 8.10.2018. The petitioner has

Patna High Court CR. MISC. No.11975 of 2019(3) dt.12-04-2019 2/2 been made accused due to mistake of fact. Altogether 32 persons are named in the F.I.R. along with 100-150 unknown persons. No specific allegation has been made agaisnt the petitioner. Other co-accused has been granted bail vide Annexure-2 to the present application.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Benipatti, Madhubani in connection with Bisfi (O.P. Patauna) P.S. Case No. 129 of 2018, G.R. No. 443 of 2018.
