At the very outset, the learned counsel for the petitioner submitted that same question has already been decided by this Court in Civil Misc. Case No.1259 of 2016 on 13.12.2016 wherein also the parties are same and the application for rejection of the plaint filed by the defendant petitioner has been dismissed. A copy of the order passed by this Court is produced before me. It appears that the point raised by this very petitioner in that civil Misc. application has been considered and this Court has passed a reasoned order.

In view of the said order dated 13.12.2016 passed in Civil Misc. case No.1259 of 2016, I find no reason to interfere with this impugned order.

It is made clear that the order dated 13.12.2016 passed in Civil Misc. Case No.1259 of 2016 shall govern this Civil

Patna High Court C.Misc. No.1448 of 2016 (2) dt.21-12-2016 2/2 Misc. application and accordingly this Civil Misc. application is also dismissed.
