The petitioner seeks bail in a case under Sections 376/511 and other sections of the Indian Penal Code. The victim made allegation that the petitioner entered into her house and made an attempt to commit rape with her but he could not succeed and fled away.

Learned counsel for the petitioner submits that the petitioner is the maternal uncle of the victim. On account of some family dispute, petitioner has falsely been implicated in the case and he is in jail since 20.08.2014.

Considering the facts aforesaid and nature of allegations made against the petitioner and the fact that petitioner has already remained in jail for about six months, he (Sk. Nurul)

No.45183 of 2014 (2) dt.23-02-2015 2 / 2 is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Bettiah, West Champaran in connection with Yogapatti (Shanichari) P.S.
