JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 23-02-2026 At the outset, learned counsel for the petitioners seeks permission to withdraw this anticipatory bail petition, so far as petitioner no. 2 (Pankaj Chauhan) is concerned.

2. The anticipatory bail petition stands dismissed as withdrawn, so far as petitioner no. 2 is concerned.

3. Rest petitioners (i.e. petitioner nos. 1, 3 & 4) apprehend their arrest in a case registered for the offence under Sections 191(2), 190, 74, 108, 352 of the B.N.S., 2023.

4. As per F.I.R., on 02.11.2025, all the named accused persons, including these petitioners, came to the house of

It is further alleged that co-accused Ramanand Chauhan caught hold of her and co-accused Pankaj Kumar committed indecent behaviour with her and thereafter, all of them tortured daughter of informant to such an extent that she consumed poison to save herself from them. Later on, in course of treatment, she died

5. Learned counsel for the petitioners submits that as per F.I.R. itself, specific accusation of committing torture and misbehaviour is against other co-accused persons. There is absolutely no allegation against these petitioners of committing torture and harassment to victim, driving her to commit suicide. He further submits that earlier, father of petitioner no. 4 also lodged a case against informant and others, vide Sitamarhi P.S. Case No. 138 of 2025. Petitioners claim clean antecedent.

6. Learned A.P.P. opposes the prayer for bail.

Considering the aforesaid facts and circumstances, in the event of their arrest/surrender within a period of eight weeks from today, let the petitioner nos. 1, 3 and 4, as named above, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate - II, Nawadah in connection with Sitamarhi P.S.

Patna High Court CR. MISC. No.8513 of 2026(2) dt.23-02-2026 3/3 Case No. 139 of 2025, subject to condition as laid down under Section 482 of the B.N.S.S., 2023.
