The petitioner apprehends his arrest in a case registered under Sections 419, 420, 409, 468, 467, 471 and 120(B) of the Indian Penal Code.
One Gajendra Prasad is said to have been appointed as Panchayat teacher on the basis of forged documents in collusion of the petitioner and other accused. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. He has been falsely implicated in the case merely because being Mukhiya he was one of the member of the Five
Patna High Court CR. MISC. No.16413 of 2019(8) dt.08-11-2019 2/2 Member Committee constituted for the appointment of the Panchayat teachers. Verification of the testimonial of the candidates was the duty of the Panchayat Sachiv and not of the petitioner. Said Gajendra Prasad has been terminated from service. He has no knowledge about refund of the money drawn by him as salary. Due to aforesaid reason, he could not furnish the said information in the Court. Said Gajendra Prasad has been enlarged on anticipatory bail by a co-ordinate Bench of this Court vide order dated 02.04.2019 passed in Cr. Misc. No. 17929 of 2019.
Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-IV, Chapra, Saran in connection with Dariyapur P.S. Case No. 377 of 2018, subject to the condition as laid down under Section 438
(2) of the Cr.P.C.
