JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2020 The petitioner seeks bail in anticipation of his arrest in connection with G.O. Case No. 913 2018, arising out of Laheriasarai P. S. Case No. 509 of 2018 dated 10.10.2018 instituted for the offences under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016. 514.82 litres of liquor is said to have been recovered from the house of one Munna Sah. The petitioner appears to have been named by the aforesaid Munna Sah even though he has got no connection with him or the consignment of liquor which is said to have been recovered. Thus, the implication of the petitioner in this case is only on the basis of confession of an arrested accused

The petitioner is a person of clean antecedents. Considering these aspects of the matter, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge cum Special Judge (Excise), Darbhanga in connection with G.O. Case No. 913 2018, arising out of Laheriasarai P. S. Case No. 509 of 2018, subject to the conditions as laid down under Section 438 (2) Cr.P.C.
