JUSTICE ASHUTOSH KUMAR ORAL ORDER 29-02-2020 The petitioner, who is in custody since 08.09.2019, seeks bail in connection with Pachrukhi P.S. Case No. 235 of 2019, dated 07.09.2019, instituted for the offences under Sections 363 and 365 of the Indian Penal Code. It appears from the narration made in the F.I.R. that the petitioner was suspected of making efforts of kidnapping a young boy as a child-lifter. The boy was never taken to any destination. Patna High Court CR. MISC. No.11282 of 2020(2) dt.29-02-2020 2/2 question recorded under Section 164 Cr.P.C., also does not refer to any act of kidnapping as is deciphered from the impugned order.

Considering the aforestated facts and taking into account the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Siwan in connection with Pachrukhi P.S. Case No. 235 of 2019.

The application stands allowed.
