2. The petitioner has prayed for regular bail in a case registered for the offence punishable under section 96 of the BNS.

3. The case of the prosecution is that the petitioner had kidnapped the minor daughter of the informant.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in connection with the present case. It is further submitted that during the course of investigation, the victim was recovered and her statement was recorded under Section 183 of the BNSS wherein she has stated that she was knowing the petitioner for

When the mother of the victim came to know about their relationship, she objected to the same, however, the victim was intent upon marrying the petitioner. It is further submitted that the petitioner had gone to Delhi for his livelihood and the victim also went there of her own volition without informing her family members. She stayed with the petitioner at Delhi for about 5-6 days and thereafter, the present case was filed by her father. It is further submitted that during the course of investigation, it has come to light that the victim is major and from perusal of the case diary, it would transpire that the victim refused to undergo medical examination. Hence, it is submitted that the present case arises out of a consensual romantic relationship between two majors. Moreover, the petitioner is languishing in judicial custody since 19.10.2025 having no criminal antecedent. 5.

Learned APP appearing for the State has vehemently opposed the prayer of regular bail.

6. Considering the aforesaid facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Khudaganj P.S. Case No. 152 of 2025 on furnishing bail bond of Rs.10,000/- (ten thousand) with two
