JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-10-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner was prisoner at the time of alleged occurrence and it is alleged that he along with fifteen named and several unknown prisoners made attempt to break the law and order in premises of jail and they not only damaged Government property but also assaulted the jail officials.

The contention on behalf of the petitioner is that prisoners raised their voice in respect of suspicious death of a prisoner and, thereafter, the jail officials lodged this case with a view to put pressure upon the prisoners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.46967 of 2015 (2) dt.07-10-2015 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of SubDivisional Judicial Magistrate, East, Muzaffarpur in connection with Mithanpur P.S.Case No. 117 of 2015.
