2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 120B/34 of the Indian Penal Code and Sections 66(C), 66(A) of the Information Technology Act.

3 . As per prosecution case, on secret information , a raid was conducted in Biryani Hotel where police personnel apprehended two persons who used to run a gang of online fraud. It is alleged that motorcycle of the petitioner was parked in front of the hotel in question .

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and his name transpired on the basis of confessional statement of co-accused

Patna High Court CR. MISC. No.9136 of 2025(2) dt.19-02-2025 2/2 who was apprehended on the spot. No incriminating material has been recovered from conscious possession of the petitioner. Petitioner claims clean antecedent. Similarly situated coaccused persons have already granted bail by this Court vide order dated 04.09.2024 in Cr. Misc. No. 43182 of 2024 . 5 . Learned A.P.P. for the State vehemently opposed the bail application .

Considering the nature of accusation and clean antecedent, this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Jokihat P. S. Case No. 119 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure .
