JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-06-2019 The petitioner has lodged a complaint with the SubDivisional Officer Sadar, District-East Champaran at Motihari (respondent no.6) saying that the private respondent no.9 has obtained selection as PDS Dealer on the basis of the forged certificate. The petitioner claims that she had filed an application under Right to Information Act requesting the Assistant District Supply Officer, Sadar East Champaran to make available a copy of the certificate of respondent no.9. She

Patna High Court CWJC No.3170 of 2019(2) dt.25-06-2019 2/3 has obtained certain information thereon vide Annexure-4 to the writ application and thereafter filed her objection with the SubDivisional Officer vide Annexure-5, 6 and 7 to the writ application. She has also lodged a complaint vide Annexure-8, but the grievance of the petitioner is that her complaint has not been looked into and it has remained unattended so far. Learned counsel for the State submits that the respondent no.9 has been granted licence considering her educational qualification of intermediate in which she has secured higher percentage than the petitioner. It is further submitted that the complaint lodged by the petitioner regarding genuineness of the certificate has been sent to the District Education Officer, East Champaran for verification and further action in the matter will depend upon the outcome of the enquiry.

In view of the stand taken in the counter affidavit stating that the complaint of the petitioner has been sent for enquiry and further action will be taken based on the enquiry report, no further order is required to be passed by this Court save and except to say that the officer concerned shall act independently and would conclude the enquiry in this regard within a period of 90 days from the date of receipt/production of
