Petitioner seeks bail in a case registered for the offences punishable under Sections 399,402,413,414 of the Indian Penal Code and 25 (I-B)a, 26,35 Arms Act. Allegation is that one loaded country made pistol was recovered from the petitioner.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 05.10.2018. Charge sheet has been submitted in the case. There is no allegation of tampering with the witnesses. Petitioner has falsely been implicated in the present case. There is no compliance of Section 100 of Cr.P.C.

On behalf of the State, it is submitted that the

Patna High Court CR. MISC. No.14647 of 2019(4) dt.15-05-2019 2/2 petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Piro (Hasan Bazar) Police Station Case No.325 of 2018, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
