JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 19-07-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Sections 147, 148, 149, 447, 323, 324, 307, 379, 504, 427 of the Indian Penal Code.
Prosecution case is that while the informant was at his house, petitioner along with other accused persons came and started assaulting the informant by means of fits, slaps and danda. It is alleged in the FIR that accused persons also assaulted Tushar Kumar, wife of the informant, daughter-in-law and grand-daughter of the informant.
Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case due to land dispute. He submits that general and omnibus allegation has been alleged against the petitioner. There is

No.18477 of 2021(2) dt.19-07-2021 2/2 specific allegation upon co-accused Harendra Rai who hit a blow of farsa on the head of informant's grand due to which he sustained severe injury on his shoulder. He submits that similarly situated co-accused has been granted bail by a Bench of this Court in Cr. Misc. No. 33055 of 2020. He further submits that petitioner bears one criminal antecedent as stated in para-3 of the bail application and he is languishing in judicial custody since13.11.2020.
Considering the facts and circumstances of the case and the fact that the similarly situated co-accused has been granted bail, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Mahua P.S.
