JUSTICE MOHIT KUMAR SHAH ORAL ORDER 11-04-2023 The present writ petition has been filed seeking the following relief :- " (i) For issuance of an appropriate writ, order or direction, particularly in the nature of certiorari, for quashing the Letter No. 58 dated 30.06.2014 issued by the Assistant Inspector General of Registration, Bihar, Patna, whereby and whereunder the petitioner along with his brother, Hiralal Sah, was directed to deposit deficit stamps of Rs. 30,360/- with fine of Rs. 3100/- and Rs.

45780/- with fine of Rs. 4600/- within 60 days through challan as per order dated 12.06.2014 passed in Stamp Case No. 41 of 2013-14 by the respondent no. 2 and to get the instruments (sale-deeds) stamp-reported

Patna High Court CWJC No.19907 of 2016(2) dt.11-04-2023 2/2 properly. It was also ordered that certificate proceeding would be initiated in case of non-payment/deposit of proper stamps."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to challenge the order dated 12.06.2014, passed by the Assistant Inspector General of Registration, Tirhut Division, Muzaffarpur, by filling appropriate appeal. Liberty so sought, is granted. It is needless to state that in case, appropriate appeal is filed within a period of four weeks from today, the appellate authority shall consider the same on merits, without being impeded by the issue of limitation and pass a reasoned and a speaking order, forthwith.

The writ petition stands disposed off on the aforesaid terms.
