2. This is the first regular bail application of the petitioner seeking his regular bail in connection with Mansi P.S. Case No. 275/2024, registered for the offence under Sections 109, 103(1), 352, 351, 3(5) of BNS Act.
3. According to the case of prosecution, it is alleged that on 17.11.2024, co-accused Arjun who is the husband of the present applicant fired upon the informant Ashok Poddar as well as son Ankit Kumar, due to that, both of them sustained injuries and due to injury Ankit Kumar died. The matter was reported by Ashok Poddar and on the basis of report made by him offence has been registered. Against the present applicant it is alleged that at the time of incident, she was also present on the spot.

4. It is submitted by the learned counsel for the petitioner that the petitioner is innocent and falsely implicated in this case. Only allegation against her is that at the time of incident she was merely present there. He further submits that the applicant is in custody since 19.112024. She is a lady aged about 36 years. Charge-sheet has been already filed, therefore it is prayed that applicant may be granted benefit of bail.
5. Learned counsel for the State opposes the arguments raised by the counsel for the petitioner.
6. Considering the above submissions made by the learned counsel for the petitioner and further considering the fact that the specific allegation of firing is against the co-accused Arjun and his son, I am of the view that the petitioner should be enlarged on bail.
7. Accordingly, the application is allowed.
8. The petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M Khagaria, in connection with Mansi P.S. Case No. 275/2024. (Arvind Singh Chandel , J) krishnakant/- U T
