JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 09-11-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. This application for grant of regular bail arises out of Motipur P.S. Case No. 180 of 2015, disclosing offences under Sections 25(1-b)a 26 (ii) 35 of the Arms Act. It is submitted on behalf of the petitioner that from his possession one loaded country made pistol with a live cartridge is alleged to have been recovered by the police. Learned counsel for the petitioner submits that the petitioner is in custody since 16.07.2015 and charge-sheet has already been submitted on conclusion of investigation by the police. He submits that there is no chance of the petitioner tampering with the evidence or fleeing from the course of trial. It

Patna High Court Cr.Misc. No.47505 of 2015 (2) dt.09-11-2015 has been stated that the petitioner has no criminal antecedent. Considering the submissions as noted above, this application is allowed. Let petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate (West), Muzaffarpur in Motipur P.S. Case No. 180 of 2015.

This is subject to the condition that the petitioner shall present himself before the police/Court, as the case may be, and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
