JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 18-02-2019 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. The petitioners are seeking anticipatory bail in connection with Trial No. 1075 of 2018 arising out of LNMU P.S. Case No. 262 of 2015 registered under Sections 323, 341, 354, 354D, 447, 448, 504, 506 and 34 of the Indian Penal Code.

Learned counsel for the petitioners submits that these petitioners are students and belong to respectable family having no criminal antecedent. It is submitted that the allegation against the petitioners is that on the alleged date they forcibly entered in the house of the informant, abused

It is submitted that in course of investigation the petitioners have fully cooperated with the police and it is a case of false implication as the petitioners as well as the family of the informant are residing in the same Mohalla and had some trivial issues they have been falsely implicated. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner alleging that the petitioners made fake facebook account in the name of the informant and hurled abuses and threats to the informant.

Considering the facts and circumstances of the case taking into consideration that these petitioners are students and are said to have no criminal antecedent, in the event of their arrest/surrender before the court below within a period of four weeks, let the above-named petitioner be enlarged on bail furnishing bail bond of Rs. 15,000/- (Rupees Fifteen Thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga, in connection with Trial No. 1075/2018 arising out of L.N.M.U. P.S. Case No.

Patna High Court Cr.Misc. No.8611 of 2019(2) dt.18-02-2019 3/3 and shall cooperate in course of investigation. This will be in addition to condition prescribed under Section 438(2) of the Code of Criminal Procedure.
