JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 04-03-2015 The petitioner is in custody since 07.07.2014 in relation to Banka (Barahat) P.S. Case No.196 of 2014 instituted under Sections-147, 148, 149, 341, 323, 324, 307 and 504 of the Indian Penal Code.
Learned counsel for the petitioner draws attention of this Court to the F.I.R. in which the informant apparently admits that he is not an eye-witness and he has not seen the occurrence. He was named by one injured, namely, Bambam Yadav whose statement has not yet been recorded by the police which is evident from the order of the learned Judge while rejecting the bail application. It is also pointed out that one co-accused in the identical allegation has been granted bail by this Court in Cr.
Patna High Court Cr.Misc. No.44266 of 2014 (02) dt.04-03-2015 2/2 Misc. No.38969 of 2014 vide order dated 30.01.2015. Be that as it may, the petitioner, namely, Bhujangi Yadav, shall be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of like amount each to the satisfaction of learned C.J.M., Banka in connection with Banka (Barahat) P.S.
