2. The petitioner is apprehending arrest in connection with Barari P.S. Case No. 218 of 2024 registered on 05.07.2024 for the offences punishable under Sections 147, 341, 323, 325, 307, 379, 504 and 506 of the Indian Penal Code.
3. According to the prosecution, the present F.I.R. has been lodged against nine accused persons, including the petitioner. It is alleged that all the accused persons abused and assaulted the informant. Specifically, it is alleged that the petitioner assaulted the informant on the head with an iron rod, causing injury. The accused persons are also alleged to have taken a gold chain and a ring from the informant.
4. It is submitted by learned counsel for the petitioner that the petitioner is innocent and has committed no offense, and that the petitioner's antecedents are clean. He further submits
Patna High Court CR. MISC. No.7151 of 2025(2) dt.19-02-2025 2/3 that both the petitioner and the informant are agnates and the allegation has been made in the background of a land dispute. Moreover, there is a case and counter-case between the parties. The case filed by the informant's side is Barari P.S. Case No. 218 of 2024, whereas the case filed by the petitioner's side is Barari P.S. Case No. 219 of 2024. The injury report, annexed as Annexure-P/3, suggests that the injury is simple in nature.
5. Learned APP for the State though opposes the petitioner's bail application but submits that, according to the injury report, the injury is simple in nature. He further submits that there is a case and counter-case between the parties.

In the facts and circumstances, let the above named petitioner be released on bail, in the event of arrest or surrender before the Trial Court within a period of four weeks from today, on furnishing bail bond of ₹30000/- (thirty thousand) as mentioned in Section 2(1) (d) of the Bharatiya Nagrik Suraksha Sanhita, 2023 to the satisfaction of the ACJM-1, Katihar, in connection with Barari P.S. Case No. 218 of 2024, subject to the conditions as laid down under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
