2. The petitioner seeks regular bail in connection with Hajipur Town P.S. Case No. 125 of 2023 registered for the offence under Sections 302, 304(B), 498A, 201/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner is said to be the husband of the deceased (victim). Petitioner is alleged to have kidnapped the informant's daughter (victim) and forcibly solemnized marriage with her.
4. Learned counsel for the petitioner submits that the petitioner is a person of clean antecedent and is in custody since 29.02.2023. He further submitted that initially the case
Patna High Court CR. MISC. No.10515 of 2024(2) dt.22-02-2024 2/2 was registered under section 302, 304(B), 498A, 201/34 of the IPC but charge sheet have been submitted under section 498(A), 306, 201, 120B/34 of the Indian Penal Code.
5. Learned A.P.P. has vehemently opposed the prayer for bail.
6. Considering the fact that the charge-sheet have been submitted and it has been found that it is a case of suicide, this application for regular bail is allowed.
7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate.
