JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 11-07-2017 Learned counsel appearing for the State points out that in two identical cases bearing CWJC No. 18308 of 2016 and CWJC No. 18267 of 2017, the counter affidavit has been wrongly filed, therefore, he may be permitted to exchange the counter affidavit and place the same on the correct record. Patna High Court CWJC No.18267 of 2016 (6) dt.11-07-2017 2/3 grievance of the petitioner is that for the purpose of providing drinking water in the district of Darbhanga advantageous steps have been taken and even though certain schemes have took place but they are not being executed properly.
The respondents have filed a detailed counter affidavit and on going through the counter affidavit filed by Respondent Nos. 3 & 6, we see the scheme for supplying water to the area in question has been formulated, work has been allotted to M/s. Kirloskar Brother Limited and agreements have been executed and the project is in the phase of implementation and the first phase of the project is completed and in the affidavit it is stated that entire project is likely to be concluded by October, 2017.
The respondents in their counter affidavit undertaken to ensure that the project is completed within time stipulated subject to their being no hindrance created at the instance of the persons who are interest with the work and filed CWJC Nos. 16303 of 2016 and 17110 of 2016, which are pending before this Court.
Keeping in view the aforesaid, we direct the respondents to ensure that the project is completed within time stipulated as per the details as indicated in the counter affidavit. In
Patna High Court CWJC No.18267 of 2016 (6) dt.11-07-2017 3/3 case any order is passed in the pending cases as indicated above and any hindrance is created, the respondents will have liberty to seek extension of the aforesaid time.
With the aforesaid finding, no further interference is called for in the matter.
The writ petition stands disposed of.
