1. Heard learned Counsel for the petitioner and learned Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out of Barari Police Station Case No. 234 of 2024, dated 02.08.2024, disclosing offences punishable under Sections 126(2)/115(2)/137(2)96/35192)/3(5) of the Bhartiya Nyaya Sanhita, 2023.

3. The prosecution case, as per the First Information Report, is that in the night of 30.07.2024, the daughter of the informant, aged about 151⁄2 years, was missing and during the search, the informant came to know that her neighbour, Sanoj Kumar, has eloped with her with the help of the petitioner and one Suraj Kumar Sharma and

Patna High Court CR. MISC. No.7264 of 2025(3) dt.12-05-2025 2/3 when the informant went to the house of the petitioner for enquiring whereabouts of her daughter, the accused persons, including the petitioner, abused her and threatened her of dire consequences.

Learned Counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case merely because she happens to be the mother of the co-accused Sanoj Kumar, who allegedly eloped the daughter of the informant. He further submits that during the investigation, the daughter of the informant was recovered by the police and she, in her written statement before the police under Section 180 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has stated that she had gone to Karnal with the co-accused Sanoj Kumar out of her own will and she has performed marriage with him and she is 5-months pregnant.

Regards being had to the submissions advanced on behalf of the parties and taking into consideration the statement of the daughter of the informant under Section 180 of the Bharatiya Nagarik Suraksha Sanhita, 2023, and the fact that the petitioner is the mother of co-accused Sanoj Kumar and there is no overt act against her, I am

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Chief Judicial Magistrate, Katihar, in connection with Barari Police Station Case No. 234 of 2024, subject to the condition laid down under Section 482 (2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.
