Petitioner is accused in connection with Majhaulia P.S. Case No.09 of 2014 registered under Section 304B/34 of the I.P.C.

The accusation is of killing of daughter of the informant by her husband and in-laws causing burn injury. Learned counsel for the petitioner submits that in fact, the deceased, wife of the petitioner, sustained burn injury due to falling of lamp. Thereafter, she was rushed to Sagauli Hospital and from there she was brought to Patna and the information was also given to the informant, father of the deceased, who was also present. Later on, the deceased died in Patna in course of

Patna High Court Cr.Misc. No.50974 of 2015 (3) dt.05-02-2016 2/2 treatment, but due to ulterior motive, informant has lodged the present case, while it is alleged in the F.I.R. that the statement of the deceased was got recorded by the informant at the Police Station, Ramkrishna Nagar, Patna but nowhere statement of the victim has been detailed in the case diary. Further, submission is that charge-sheet has already been submitted in the present case and the petitioner is in custody since 09.12.2014. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., West Champaran, Bettiah in connection with Majhaulia P.S. Case No. 09 of 2014.
