JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 12-05-2023 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offence punishable under Sections 341, 323, 324, 326, 379, 504, 506/34 of the Indian Penal Code.
Allegation against the petitioner is that he along with other accused assaulted the informant and his family with lathi, rod and sword. It is also alleged that the petitioner assaulted the son of the informant by means of sword. Petitioner is also alleged to have assaulted the informant by means of rod and as a result he sustained injury on his left hand.
Learned counsel for the petitioner submits there is general and omnibus allegation against the petitioner. Case and counter case. The petitioner claims clean antecedent. Learned counsel for the State opposes the bail petition
Patna High Court CR. MISC. No.9275 of 2023(2) dt.12-05-2023 2/2 of the petitioner and submits that there is specific allegation of against the petitioner that he assaulted the informant and his son and both of them have sustained injuries.
Considering the fact that there is specific allegation of assault against the petitioner and taking into account the nature of injury, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Alok Verma/- U T
