Petitioner seeks bail in a case registered for the offences punishable under Sections 376 of the Indian Penal Code and 3/4 of Protection of Children from Sexual Offence Act,2012(POCSO) Act.

According to FIR, the petitioner allegedly ravished to the daughter of the informant, a minor girl. The medical report shows that the Doctor has assessed age of the girl between 13 to 15 years. The victim has also supported the allegation in her statement under Section 164 Cr.P.C. Submission is that just to pressurize for marriage, false case has been lodged.

Considering the nature of allegation and

No.8834 of 2019(3) dt.26-04-2019 2/2 material, I am not inclined to enlarge the petitioner on bail in connection with Khagaria Mahila P.S.Case No.38 of 2018 arising out of G.R.No.1994 of 2018 pending in the court of learned Additional Sessions Judge-1st-cum-Special Judge, POCSO, Khagaria. Hence, prayer is refused.

The petitioner is in custody since 14.09.2018, hence the learned Trial Court is directed to expedite the trial. (Birendra Kumar, J) Nitesh/- U T
