JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-02-2020 Petitioner seeks bail in connection with Bhagwanpur Hat P.S. Case No. 170 of 2017, registered for the offences punishable under Sections 363 and 366A of the Indian Penal Code.

There is allegation of kidnapping of minor daughter of the informant by the petitioner and other accused persons. Submission of learned counsel for the petitioner is that the victim girl in her statement recorded under Section 164 Cr.P.C. has named all the accused persons but specifically stated about commission of rape against one Sandeep Kumar Sharma, who has been granted bail by a co-ordinate Bench of this Court by order dated 7.3.2018 passed in Cr.Misc.No. 5831 of 2018 and petitioner is in custody since 11.12.2019.

In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-II, Siwan, in connection with Bhagwanpur Hat P.S. Case No. 170 of 2017.
