ANJANA PRAKASH ORAL JUDGMENT Date: 26-11-2015 The Petitioner seeks revision of the judgment of conviction dated 27.07.2015 passed by the 5th Additional District & Sessions Judge, Nalanda at Biharsharif in Criminal Appeal No. 30 of 2006, by which he has affirmed the judgment dated 06.03.2006 passed by the Judicial Magistrate, 1st Class, Nalanda at Biharsharif in Tr. No. 1546 of 2006 (G.R. no. 91 of 2005) arising out of Silao (Rajgir) P.S. Case No. 19 of 2005, by which he has convicted the Petitioner under Section 25(1-B) A of the Arms Act and sentenced him to undergo R.I. for two years and fine of Rs. 2,000/-. Having gone through the judgment of conviction, I do not find any merit in the application.
However, considering the period of custody and the date of occurrence, the sentence is reduced to the period already undergone by the Petitioner.
Patna High Court CR. REV. No.823 of 2015 dt.26-11-2015 With the aforesaid observations, the application stands dismissed.
However, the Petitioner shall deposit a fine of Rs. 2,000/- (Two Thousand) within two weeks from the date of receipt of this order.
