The petitioner is accused in connection with Ramkrishna Nagar P.S. Case No. 298 of 2018 registered under sections 302, 201, 307, 120B and 34 of the I.P.C. pending in the Court of A.C.J.M.-XIII, Patna.
Submission of learned counsel for the petitioner is that petitioner is in custody since 11.08.2019. He is innocent and has falsely been implicated in this case due to oblique reasons. There is no eye witness to the alleged occurrence. Learned A.P.P. appearing on behalf of the State opposed the prayer of the petitioner with submission that petitioner is named in the first information report. In the several
Patna High Court CR. MISC. No.10684 of 2019(4) dt.11-04-2019 2/2 paragraphs of the case diary, the witnesses have also supported the prosecution version and the petitioner along with other accused persons have committed the alleged occurrence. Having considered the facts and circumstances of the case and nature of allegation, I am not inclined to allow the prayer of the petitioner for bail. Accordingly, this application is rejected.
However, liberty is granted to the petitioner to renew his prayer for bail after framing of charge.
