Permission is accorded. It may be done in course of the day.
Heard learned counsel for the parties.
The petitioners pray for bail in a case registered for the offence under Section 30(a) of Bihar Prohibition and Excise Act.
Petitioners alongwith co-accused Babloo Ram were apprehended with 279 liters of Nepali Saufi Wine.
Patna High Court CR. MISC. No.9167 of 2022(3) dt.21-04-2022 2/2 It is submitted on behalf of petitioners that nothing has been recovered from the conscious possession of the petitioner. Petitioners claim clean antecedent and they are in custody since 06.11.2021. Investigation is complete. Learned A.P.P. for the State has opposed the bail petition.
Considering the nature of allegation, clean antecedent and period of custody, the bail petition of petitioners is allowed. Let the above named petitioners be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge, Exclusive Excise Court - II, Sitamarhi in connection with C2 Case No. 514 of 2021.
