Learned counsel for the Bihar State Tourism Development Corporation submits that the present writ application has been rendered infructuous as the period under the agreement is two years, expandable up to five years and the period of five years is going to be completed on 14.5.2017 and it has been submitted by Corporation that the petitioner would not be disturbed till 14.5.2017 but, from the letter dated 15.2.2017, it appears that the petitioner has to pay an outstanding dues of Rs. 5,13,235/-.

Patna High Court CWJC No.18407 of 2016 dt.16-02-2017 Learned counsel for the petitioner submits that he would deposit Rs. 5,13,235/- by 28.3.2017 and if he deposit the aforesaid amount, the petitioner will be at liberty to file proper application for reconciliation of account. Learned counsel for the petitioner also undertakes that without creating any nuisance, he will vacate the premises on and before 14.5.2017.
