Mrs. Kanak Verma, CGC ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE and HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 06-01-2020 This petition filed on 15.11.2017 is listed for hearing for the first time today before the Court.

Heard learned counsel for the petitioner and learned

Patna High Court CWJC No.16703 of 2017(2) dt.06-01-2020 2/2 counsel for the respondents.

The petitioner has prayed for the following relief:- "For issuance of appropriate writ (s), order (s), direction (s) commanding the respondents concerned to get the correct census report of Baniyapur Gram Panchayat, Chapra, Saran, as per the report of respondent no.8 and to declare the said Gram Panchayat under reserved category for the purpose of Panchayat Election as the Block level authorities under some political pressure have prepared and sent the manipulated census report showing total population of Scheduled Castes as only 951 whereas at present it is about 1609 which has resulted into denial of reservation benefits to the scheduled caste population of the Baniyapur Gram Panchayat, and/or grant any other relief(s) as deem fit and proper in the facts and circumstances of this case."

In our considered view, the present petition has become infructuous inasmuch as the elections were conducted on 2nd of May, 2016 as is so stated by Shri Amit Shrivastava, learned counsel for the respondent no.4- the Chief Election Officer, State Election Commission, Bihar, Patna. Accordingly, the petition stands disposed of. (Sanjay Karol, CJ) ( Anil Kumar Upadhyay, J) Sunil/- U
