The petitioner has filed the instant application for the following relief(s):- "That this writ petition is being certiorari quash the order dated 30.7.2015 passed by the District Magistrate, Kaimur Bhabhua in Vasgit Parcha Appeal No. 9/13-14. The Learned Collector wrongly passed this order."

The petitioner in the instant application has challenged the order dated 30.7.2015, passed in Vasgit Parcha Appeal no.9/13-14, by the District Magistrate, Kaimur at Bhabhua.

Patna High Court CWJC No.5577 of 2018(4) dt.28-04-2023 2/2 At the outset, learned counsel for the respondents submits that the petitioner has an alternate and efficacious remedy of moving before the Tribunal constituted under the Bihar Land Disputes Resolution Act, 2009.

After some argument, learned counsel for the petitioner seeks permission to withdraw this application seeking liberty to move before the said Tribunal.

The writ application stands disposed of with the aforesaid liberty.

In case, an application for condonation of delay (limitation petition) is filed by the petitioner along with filing of the aforesaid application, the Tribunal shall take into consideration the period for which the instant case was being pursued by the petitioner in this Court.
