The petitioner is apprehending his arrest in connection with Manigachhi P.S.Case No.177 of 2018 registered for offences punishable under Sections 394 and 411 of the Indian Penal Code.

Prosecution case as per the FIR is that the vehicle of the informant was intercepted by the Red Colour car and thereafter the pick up van was taken away by two persons sitting in the car and two persons were following it by the car, however at the toll Plaza the informant raised hulla and the accused persons sitting in the Pick up Van have been arrested and two miscreants succeeded in fleeing away and the persons who were arrested disclosed the name of the petitioner and the other accused persons who succeeded in fleeing away.

Patna High Court CR. MISC. No.7483 of 2019(4) dt.09-05-2019 2/2 Submission of the learned counsel for the petitioner is that the petitioner has been named by the other accused persons and except that there is nothing against the petitioner. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioner and the provisional bail earlier granted to the petitioner, vide order dated 8.2.2019 passed in the instant case, is withdrawn, and the petitioner is directed to surrender before the learned court below and make prayer for regular bail, which will be considered by the learned court below on its own merit.

With the aforesaid direction, this application is dismissed.
