JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks regular bail in connection with Barachatti P.S. Case No. 133 of 2019 registered for the offence(s) punishable under Sections 8, 15, 18(c), 25, 20 and 22 of N.D.P.S. Act.

Allegation on petitioner is of cultivation of opium. Submission of the learned counsel for the petitioner is that he has nothing to do with field. He has no criminal antecedent. He is in custody for more than 3 months and chargesheet has already been submitted. Heard learned A.P.P. also.

Having heard both sides, in view of the submissions, made above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the

Patna High Court CR. MISC. No.6512 of 2020(2) dt.05-02-2020 2/2 satisfaction of learned Sessions Judge, Gaya, in connection with Barachatti P. S. Case No. 133 of 2019, subject to the condition that, in future, if he is found to be involved in such cases then the prosecution is at liberty to move for cancellation of his bail bond.
